Shipping and Delivery
United States Orders. MICHAEL TODD true organics ships to destinations within the United States including Hawaii and Alaska ("US") and including P.O. Boxes and Military APO/FPO addresses. Flat rate shipping and handling of $5.50 on orders up to $45 and FREE shipping and handling on orders of $45 or more apply for regular delivery, Monday through Friday. Shipment will normally be made within 1-2 days after receipt of purchase order. Once the order is shipped, you will receive email confirmation containing the tracking number. Be sure to provide us with a complete shipping address, including postal code. We cannot be responsible for incomplete shipping addresses. Items returned for this reason will not be eligible for a refund.
International Orders. MICHAEL TODD true organics ships worldwide (other than Italy*) via the United States Postal Service and offers flat rate shipping and handling of US$5.95 to Canada and US$7.95 to all other destinations for regular delivery outside the United States shipped and delivered on business days Monday through Friday, excluding major holidays. Shipment will normally be made within 1-2 days after receipt of purchase order. Once the order is shipped, you will receive email confirmation. Delivery times vary depending on destination and are listed by country at the bottom of any page of the website. Tracking information is not available on International shipments. Be sure to provide us with a complete shipping address. Postal codes are required to be provided for all countries except countries not using postal codes. We cannot be responsible for incomplete shipping addresses. Items returned for this reason will not be eligible for a refund.
* Sorry. As a result of frequent delivery issues, we are no longer shipping to destinations in Italy.
VAT and Duties. Orders for delivery to destinations outside the U.S. may be subject to VAT and duty levied once your order reaches your country. You are responsible for for these charges. If incurred, VAT and duty must be paid before your package will clear customs. We cannot make adjustments to your order to avoid these charges. When customs clearance procedures are required, this can cause delays beyond our original delivery estimates. Orders refused for delivery due to failure or refusal to pay VAT or duty charges are not eligible for a refund.

Guaranty / Returns
Satisfaction Guaranty. We want you to be completely satisfied with your purchases of MICHAEL TODD true organics products. Therefore, except in certain limited circumstances described below, if for any reason you're not happy with your purchase, send it back within 30 days of receipt for an exchange or full refund of the purchase price, less a $10.00 shipping and handling charge. That's all there is to it.
Purchases from MICHAEL TODD true organics are generally subject to our Terms and Conditions which can be found on this page. The time limitations for returns must be strictly complied with in order to qualify for a refund.
Certain Orders Not Subject to Refunds. Certain orders are not subject to refunds under our general Satisfaction Guaranty. Sorry, but purchases of products with vouchers obtained from third parties, including Groupon and Living Social, are subject to replacement for defects in materials or workmanship but not refunds. Also, international orders refused for delivery due to failure or refusal to pay your country's VAT or duty charges are not eligible for a refund. Finally, products returned due to incomplete or inaccurate shipping addresses are not eligible for a refund.
Order Processing
• Orders are processed and shipped on business days only Monday through Friday, excluding major holidays.Most orders are processed within 1 - 2 business days (processing time does not include weekend days).
• Orders placed on Saturday and Sunday will be processed the following Monday.
• All purchases are subject to bank authorization prior to processing. Only authorized purchases may be processed and shipped.
• Orders being sent to P.O. Boxes or Military APO/FPO addresses must be shipped via the United States Postal Service.
Payment Options
MICHAEL TODD true organics accepts the following methods of payment: American Express, Visa, Mastercard, Discover and PayPal. We do NOT accept the following methods of payment: CODs, personal checks or money orders. We reserve the right to refuse any order that does not meet these criteria. To use PayPal, you will need to enter a U.S. postal or zip code where indicated in the checkout process. If you do not have one, you can enter any five digit number and you will be transferred to PayPal’s website to complete your purchase.
Promotions / Discount Codes
To redeem special offers, simply enter your coupon or voucher code in the text box marked “Discount Codes” on the Shopping Cart page during the checkout process and click on “Apply Coupon.“ A text block will appear at the top of the pageconfirming when an offer code is accepted. Offer codes are not case sensitive. Only one offer code may be used per online order. Discounts are not applied to charges for shipping. A fixed amount discount (as distinguished from a percentage discount) which is greater than the selling price of the product or products being purchased will be applied up to the amount of the purchase price only and any excess may not be carried forward to a subsequent purchase.

Maximum Purchase Policy
We reserve the right to limit orders to no more than three (3) units of any item with a maximum single purchase of $350 per customer.

Billing

Out of Stock and Backorders
If an item selected is temporarily out of stock at the time of your order, you will be notified via email and advised of the expected ship date of the backordered item. Backordered items are shipped as soon as they are available. If there are other items in your order that are in stock, they will be shipped to you. You will not be charged for any item unless it is shipped. Order Cancellations

Occasionally, orders or parts of an order are cancelled by our system for various reasons. Some reasons include:

Sales Tax
We are required to collect and pay over sales tax to the taxing authorities on your purchases of products for shipment in the United States into states in which we have a substantial connection such as an office or place of business (called, a "nexus"). Based on this nexus requirement, we are required to collect state sales tax on orders shipped to destinations inside the States of Florida and South Carolina only. The applicable tax will be separately stated and added to your purchase at the shopping cart for registered guests and at the checkout for unregistered guests.

Dispute Resolution and Binding Arbitration. YOU AND MICHAEL TODD TRUE ORGANICS ARE AGREEING TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM. OTHER RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT, SUCH AS ACCESS TO DISCOVERY, MAY ALSO BE UNAVAILABLE OR MAY BE LIMITED IN ARBITRATION.
ANY CLAIM, DISPUTE, OR CONTROVERSY (WHETHER IN CONTRACT, TORT, OR OTHERWISE, WHETHER PRE-EXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, CONSUMER PROTECTION, COMMON LAW, INTENTIONAL TORT, INJUNCTIVE AND EQUITABLE CLAIMS) BETWEEN CUSTOMER AND Michael Todd True Organics, its agents, employees, principals, successors, assigns, affiliates (collectively for purposes of this paragraph, "Michael Todd") arising from or relating to this Agreement, its interpretation, or the breach, termination or validity thereof, the relationships which result from this Agreement (including, to the full extent permitted by applicable law, relationships with third parties who are not signatories to this Agreement), Michael Todd true organic's advertising, or any related purchase SHALL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) or JAMS such arbitration to take place solely in St. Lucie County, Florida. Arbitration proceedings shall be governed by this provision and the applicable procedures of the selected arbitration administrator, including any applicable procedures for consumer-related disputes, in effect at the time the claim is filed. Consumer claimants (individuals whose transaction is intended for personal, family, or household use) may elect to pursue their claims in small-claims court rather than arbitration. The arbitration or small-claims court proceeding will be limited solely to the individual dispute or controversy between customer and Michael Todd.
You agree to an arbitration on an individual basis. In any dispute, NEITHER CUSTOMER NOR MICHAEL TODD true organics SHALL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER CUSTOMERS, OR ARBITRATE ANY CLAIM AS A CLASS REPRESENTATIVE, CLASS MEMBER OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. If any provision of this arbitration agreement is found unenforceable, the unenforceable provision shall be severed, and the remaining arbitration terms shall be enforced (but in no case shall there be a class arbitration).
The arbitrator shall be empowered to grant whatever relief would be available in court under law or in equity. This transaction shall be governed by the Federal Arbitration Act 9 U.S.C. sec. 1-16 (FAA). Any award of the arbitrator(s) shall be final and binding on each of the parties, and may be entered as a judgment in any court of competent jurisdiction. Michael Todd will be responsible for paying any individual consumer's arbitration fees. If you prevail on any claim that affords the prevailing party attorneys' fees, the arbitrator may award reasonable fees to you under the standards for fee shifting provided by law.
